Terms of Service

These terms govern the use of NIM Reach, a WhatsApp Business messaging service operated by NEXINFINITY META (OPC) PRIVATE LIMITED ("we", "us"). By creating a workspace or using the service, the business ("you") agrees to them.

1. The service

NIM Reach lets you connect your WhatsApp Business number and use it to send approved message templates, run broadcast campaigns, reply to customers from a shared team inbox, and set up automatic replies. Messages are carried by Meta's WhatsApp Business Platform, which we do not control.

2. Your account

  • You are responsible for the people you invite to your workspace and for what they do in it.
  • Keep sign-in details private, and tell us promptly if you believe your account has been misused.
  • You must be authorised to act for the business whose WhatsApp number you connect.

3. Your obligations when messaging people

  • Follow the WhatsApp Business Messaging Policy, the WhatsApp Commerce Policy and Meta's other terms that apply to your use of WhatsApp.
  • Message only people who have agreed to hear from you, and record how they agreed. The service will not send marketing to a contact without a recorded opt-in.
  • Stop messaging anyone who asks you to. The service stops marketing automatically when a person replies with an opt-out word such as STOP.
  • Send nothing unlawful, misleading, abusive, or that infringes someone else's rights.
  • You are responsible for the content of your templates, campaigns and replies.

4. Fees

Meta charges for WhatsApp messages according to its own rate card. Those charges are billed by Meta directly to the payment method on your WhatsApp Business account; we never collect them. Estimates shown in NIM Reach are for guidance and may differ from Meta's invoice. Our own fees, if any, are as agreed with you in writing.

5. Your data

Your contacts and messages remain yours. We handle them only to provide the service, as described in the Privacy Policy. You can export your contacts and delete them at any time.

6. Availability and changes

We work to keep the service available, but it depends on Meta's platform and on our hosting providers, and it may be interrupted. Meta may restrict, pause or rate-limit a number for reasons outside our control. We may change or improve features, and will tell account owners in advance of changes that reduce what the service does.

7. Suspension and ending

We may suspend a workspace that breaks these terms or Meta's policies, or that puts the service or other customers at risk. You may stop using the service at any time and ask us to close your account; your workspace data is then deleted as the Privacy Policy describes.

8. Liability

The service is provided as it is. To the extent the law allows, we are not liable for indirect or consequential losses, lost profits or lost data, or for the actions of Meta or of the recipients of your messages. Our total liability for any claim is limited to the fees you paid us in the three months before the claim.

You agree to compensate us for claims made against us because of the messages you send or your breach of these terms.

9. Governing law

These terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu, India.
